Game Uploading and Publishing Terms

These terms and conditions define the legal agreement between the uploader (developer) and Fiuby Technology regarding the uploading and publishing of games on the Fiuby platform. Please read these conditions carefully.

Purpose of the Service

Fiuby provides a platform for developers to upload, sell, and reach gamers with their games. This service primarily focuses on indie developers and supports 2D or 3D games up to 5GB in size.

Eligibility and Responsibility

Legal Eligibility

To upload games to Fiuby, the developer must be over 18 years old or have reached the legal age in their jurisdiction. If you are a developer under 18, you must provide the bank details of your legal guardians over 18 for any earned revenue.

Rights, Ownership, and Legal Responsibility

The developer declares that the uploaded game is entirely their own creation and does not infringe on the intellectual property of any other person or organization. Uploading stolen, copied, or copyright-infringing games to Fiuby is strictly prohibited. In such cases, upon complaint by the rights holder, the game will be removed, and if there is an ongoing copyright lawsuit, the user’s information will be presented to the local court upon request.

Inappropriate Content

Although Fiuby respects personal freedoms, due to its social media nature and age restriction of 13+, games containing explicit sexual content, pornographic elements, or NSFW content considered contrary to public morality are prohibited. Such content will be removed without prior warning; the developer’s account may be suspended, and content creator information may be shared with authorities upon legal request.

Upload Requirements

Game Size and Format

1. Uploaded games must not exceed 5GB in size.
2. The game must be playable and tested.

Prohibition of Viruses and Malware

Games uploaded to Fiuby must be free of viruses or malware. The developer bears full responsibility for this, and games found to contain malicious software will be removed. Fiuby reserves the right to take legal action against users who upload harmful software.

Revenue Sharing and Payment Terms

Revenue Rates

1. Fiuby takes $0.30 + 5% from the net revenue of every game (and Bits) sold. Out of this amount, $0.30 + 2.5% is charged as the Stripe payment processing fee.
2. The remaining 95% is transferred to the developer. If you have products priced at a low amount (e.g., $1–$2), the $0.30 fee will naturally appear as a relatively high commission in your balance.

Payment Procedures

1. Amounts exceeding 50 USD will be automatically transferred to your bank account within the first 5 business days of each month.
2. Payments are made via bank transfer or EFT to the IBAN addresses provided by users. If the user has not entered their bank account details, the balance will accumulate in their account.
3. Bank transfer fees are deducted from the payment amount.

Removal and Termination

By Developer

Developers may request the removal of their game. Such requests will be processed within 7 business days. Even if removed, users who purchased the game will retain permanent access to the latest version in their Fiuby library (except for items removed by Fiuby).

By Fiuby

Fiuby reserves the right to remove games in cases of:

1. Copyright infringement claims
2. Detection of viruses or malware
3. User complaints

Termination

Fiuby reserves the right to suspend or terminate a developer’s account in case of suspicious violations or legal obligations.

Legal Disputes

All disputes between Fiuby and developers are subject to the laws of the Republic of Estonia, with Estonian courts having jurisdiction over any legal matters. By accepting these terms, the developer declares a legally binding contract to upload and publish games on the Fiuby platform. Fiuby reserves the right to modify these conditions at any time and will notify developers of any changes.
